Terms and Conditions for Top Half Guarantee

Cubby Law hereby offers a one-time non-assignable right to receive a refund of fees paid for a Cubby Law subscription only to users who paid for an annual subscription between June 15th through December 1, 2026 and also meet the following requirements set forth below. This offer does not supersede, abrogate, or invalidate any term of any other agreement you have with Cubby Law resulting from your use of the Services, including but not limited to the Terms of Use and Privacy Policy, as amended from time to time, binding on all Cubby Law users. This offer has no monetary value and may only be redeemed with Cubby by following the applicable steps set forth below. Users may not assign the right created by this offer, nor may they delegate performance of any of the conditions set forth below to qualify. In the event that a user does not submit their request for a refund within 30 days of their grades being released, and/or in the event that a user does not submit all of the required evidence of their grades within that period, this offer shall not be available to such users. The general provisions of the Terms of Use (e.g., limitations of liability, dispute resolution, etc.) apply to this offer and are hereby incorporated by reference. To the extent that any provision of the Terms of Use conflicts with any provision herein, the Terms of Use shall control. Except for the incorporation by reference of the Terms of Service, the provisions hereof are the entire agreement of the parties with respect to the subject of money-back guarantees, and no other agreements or understandings shall be binding unless memorialized in a writing signed by Cubby Law and the User, and no failure of Cubby Law to enforce its rights hereunder shall be deemed a waiver of future enforcements.

1. Minimum Usage Requirements

To qualify for the Top Half Guarantee, you must demonstrate meaningful engagement with the platform. This includes completing at least one of the following:

• At least 10 full practice exams total, or
• At least 2 full practice exams per class

OR

• At least 100 quiz questions total, or
• At least 30 quiz questions per enrolled class

OR

• At least 5 practice exams total and 50 quiz questions
• Or 1 practice exam and 25 quiz questions per class

Usage must reflect genuine academic engagement. Artificial or rushed activity intended solely to qualify for a refund will void eligibility.

"Completed" is defined as: Taking the full exam or quiz and receiving graded feedback. Partial attempts, saved drafts, or unanswered questions do not count toward this requirement.

2. Minimum Active Period

You must have used Cubby actively over a period of at least 15 separate days during the academic term.

This requirement ensures that engagement is sustained rather than last-minute.

3. Proof of Class Standing

To qualify:

• You must provide official documentation showing your class rank or percentile standing for the semester in which Cubby was used.
• Acceptable documentation includes official transcripts, grade reports, class rank letters, or registrar-issued documents that clearly indicate your position relative to the class median.
• If your school does not publish class rank or percentile, you must provide official documentation of your GPA along with the published median GPA or grade distribution for your section or class, sufficient to demonstrate whether you finished above or below the 50th percentile.

4. Definition of Eligibility

• If you finish at or above the 50th percentile of your class (i.e., at or above the median), you do not qualify for a refund.
• If you finish below the 50th percentile of your class (i.e., below the median), you are eligible for a full refund of fees paid.
• In the event of a tie at the median, students at the median are considered to have finished in the top half and do not qualify.

5. Additional Conditions

• This guarantee is available exclusively to users on an annual subscription plan.
• Requests must be submitted within 30 days of final grades being released for the fall semester.
• The guarantee applies only to the fall 2026 semester in which Cubby was actively used.
• Cubby reserves the right to verify usage activity and academic documentation.
